Clarification Text on the Processing of Personal Data

ÖZALTIN TARIM İŞLETMELERİ SANAYİ VE TİCARET A.Ş. (hereinafter the “COMPANY”) shows the utmost care for the security of your personal data. With this awareness, we attach great importance to processing and storing all personal data of everyone associated with the Company, including those who benefit from our products and services, in accordance with the Personal Data Protection Law No. 6698 (the “KVK Law”).

As Data Controller, we present this text to inform you about your rights and to obtain your consent on the matters below, within the framework of Article 10 (“Obligation of the Data Controller to Inform”) and Article 11 (“Rights of the Data Subject”) of the KVK Law.

We attach importance to protecting the confidentiality and security of the personal data you provide to us. Accordingly, we take the necessary technical and administrative measures to protect your personal data against unauthorised access, damage, loss or disclosure.

1. Collection, Processing and Purposes of Processing Personal Data

Our Company ensures easy access to the information submitted to it under agreements and contracts between the parties, healthy access by the customer to the services, and the confidential storage of that information. It keeps its systems up to date and active in order to improve the quality of its services and to make them easier and simpler to use.

Your personal data may be collected verbally, in writing or electronically, by automatic or non-automatic means, through our Company's units and offices, website, navigation and click data on applications, mobile applications and similar means. This may include name and surname, parents' names, date and place of birth, e-mail address, contact address, telephone number, address of residence, payroll information, employment entry and exit records, CV, invoice, promissory note and cheque information, purchase order information, balance sheet information, bank IBAN number, signature, fingerprint information, visual and audio recordings for employees, health information, professional experience information and criminal conviction information. Your personal data may be processed, created and updated for as long as you benefit from the products and services offered by our Company.

In addition, your personal data may be processed when you use our website, visit our Company or our website, or attend trainings, seminars or events organised by our Company.

This personal data will be processed so that you can benefit from the services we offer, based on your explicit consent or in the other cases set out in Article 5(2) of the KVK Law, in particular the legislation we are subject to. It will not be used outside the purposes and scope set out in this text, all necessary information security measures will be taken, and it will be stored for the legal retention period or for as long as the purpose of processing requires. At the end of that period it will be anonymised and may continue to be used by our Company in anonymised form.

2. With Whom Do We Share Your Personal Data?

Based on the explicit consent of customers, or in the other cases set out in Article 5(2) of the KVK Law, in particular the legislation we are subject to, and provided that adequate measures are taken within the security and confidentiality principles of the KVK Law, our Company may share your personal data with our shareholders, affiliates and subsidiaries, and with public institutions or organisations legally authorised to request it, in order to carry out the Company's activities, to offer services, opportunities and facilities to our customers and to improve service quality.

3. Method and Legal Grounds for Collecting Personal Data

Your personal data is obtained through all kinds of verbal, written or electronic media, for the purposes above, so that the products and services offered by the Company can be provided within the applicable legal framework and so that our Company can fully and accurately fulfil its contractual and legal obligations. Personal data collected on this legal basis may also be processed and transferred for the purposes set out in sections (1) and (2) of this text, within the processing conditions and purposes set out in Articles 5 and 6 of the KVK Law.

4. Rights of the Data Subject under Article 11 of the KVK Law

If you submit requests regarding your rights to our Company using the methods set out below, our Company will conclude the request free of charge within thirty days at the latest, depending on the nature of the request. However, if a fee is stipulated by the Personal Data Protection Board, the fee in that tariff will be charged. In this context, data subjects have the right to:

• learn whether their personal data is being processed,
• request information if their personal data has been processed,
• learn the purpose of processing and whether the data is used in accordance with that purpose,
• know the third parties in Türkiye or abroad to whom the personal data is transferred,
• request correction of personal data that is incomplete or incorrectly processed, and request that third parties to whom the data was transferred be notified of this,
• request deletion or destruction of personal data where the reasons for processing no longer exist, even though it was processed in accordance with the KVK Law and other relevant laws, and request that third parties to whom the data was transferred be notified of this,
• object to a result against them arising from the analysis of the processed data exclusively through automated systems,
• claim compensation for damages arising from the unlawful processing of personal data.

Pursuant to Article 13(1) of the KVK Law, you may submit requests to exercise the rights above to our Company in writing or by other methods determined by the Personal Data Protection Board. To do so, please send a signed request containing the information needed to identify you and an explanation of the right you wish to exercise under Article 11 of the KVK Law to Dedeköy Mahallesi Merkez Sokak No:11 Koçarlı/AYDIN, together with documents identifying you, by hand, through a notary public or by other methods specified in the KVK Law.

Our Company will conclude the requests in your application free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if the transaction requires an additional cost, the fee in the tariff determined by the Board will be charged. If the application is answered in writing, no fee is charged for up to ten pages, and a fee of 1 TL is charged for each page above ten. If the response is given on electronic media such as a CD or flash memory, the fee requested by our Company will not exceed the cost of the recording medium.

Pursuant to Article 10 of Law No. 6698 on the Protection of Personal Data (“Obligation of the Data Controller to Inform”), I have read and understood this Clarification Text on by whom and for what purpose my personal data will be processed, to whom and for what purpose it may be transferred, the method and legal grounds for its collection, and my rights under Article 11 of the Law, and I have been informed in detail on this matter by the “COMPANY” as data controller.
